European Commission President Ursula von der Leyen told the Financial Times on July 13, 2026 that she now backs a "harmonised EU-wide delay to social media" for children under 13, with graduated access for teenagers conditional on platforms proving their services are "age-appropriate and safe." The announcement, confirmed in a separate statement, follows the final report of the Commission's Special Panel on Child Safety Online, which met three times between March and June 2026 and recommended that under-13s be restricted to supervised, time-limited access while platforms bear the burden of proving safety by design (Euronews). Von der Leyen cited European children spending four to six hours a day on screens — "this adds up to twenty years of their life" — and framed platform responsibility as a duty of care comparable to automotive safety standards.
The Steelman
The case for intervention is not manufactured. A BMJ-published early study of Australia's Social Media Minimum Age Act — in force since December 2025 — still found that nearly a quarter of adolescents display problematic smartphone-use patterns, and 90%+ of surveyed Europeans back urgent child-protection measures, per the European Parliament's own research cited in its November 2025 resolution (European Parliament). Design features like infinite scroll, autoplay and reward loops are engineered for engagement, not wellbeing, and a 13-year-old is not equipped to negotiate that asymmetry alone. A genuinely privacy-preserving, EU-wide age floor — rather than 27 divergent national laws — would also spare platforms a compliance patchwork. That is a coherent, good-faith case, and regulators pursuing it are responding to a real harm, not a moral panic.
Where the Proposal Overreaches
The trouble is that "harmonised" is doing a lot of work in von der Leyen's framing while the underlying politics are anything but harmonised. France's National Assembly passed a bill in January 2026 barring under-15s from social media, with the Senate amending it in a first reading and the government hoping for enforcement by September; Spain's government has proposed lifting the threshold from 14 to 16; and Greece has set a January 1, 2027 start date for its own under-15 restriction. Von der Leyen's 13-year floor is, functionally, the lowest number on the table — and the European Parliament already voted 483–92 in November 2025 for a non-binding resolution favoring 16, with 13-to-16-year-olds gated behind parental consent (European Parliament). A Commission proposal pitched as unifying the bloc will instead land in the middle of a live dispute between 13, 15 and 16, and member states with laws already in motion have little incentive to walk them back to match Brussels' number.

That rhetoric outruns the evidence on enforceability. Australia is the closest real-world test of a hard age floor, and the early data is not encouraging: more than 85% of under-16s surveyed after the ban took effect were still using restricted platforms, despite two-thirds reporting they'd hit an age check. Self-declared age remained the most common check (24–39% of encounters), and teens who did face friction routed around it with fake accounts, borrowed logins or incognito browsers (TechXplore). A ban that 85% of its targets ignore is not "safety by design" — it's a compliance theater that shifts liability onto platforms without meaningfully changing what teenagers do.
The Better Lever Already Exists
The Commission's own age-verification infrastructure is a more defensible tool than a blanket age floor. Its EU-wide age-verification solution — built on the same rails as the EU Digital Identity Wallet, developed with Scytáles and T-Systems, and feature-ready since April 15, 2026 — lets a user prove they are over an age threshold without disclosing identity or browsing data (European Commission, Digital Strategy). That is the right shape of regulation: proportionate, privacy-preserving, and adjustable to 13, 16 or any other threshold member states land on — rather than a single hardcoded number imposed from Brussels ahead of the political fight that will actually determine it.
What to Watch
Von der Leyen said the Commission will review the panel's recommendations and table a formal legislative proposal "after the summer," which then goes to Parliament and the Council, where the number itself becomes the negotiation. Three things worth tracking: whether the Commission's 13 survives contact with a Parliament that already voted for 16; whether France, Spain and Greece pause their national bills pending an EU number or simply set a de facto floor above whatever Brussels proposes; and whether the final law is anchored to the Commission's own privacy-preserving age-verification wallet or defaults to platform self-certification — the same weak mechanism that let 85% of Australian teens through. The instinct to protect children online is legitimate. Whether the EU builds enforceable, privacy-respecting infrastructure or a symbolic number that teenagers route around by lunchtime is still an open question.
