For European platforms with global ambitions, Indonesia has quietly become one of the most demanding regulatory environments in the world. Under Ministerial Regulation 5/2020 (MR5/2020), implementing Government Regulation 71/2019 (PP 71/2019) on the Operation of Electronic Systems and Transactions (PSTE), any platform with Indonesian users must register as a Private Scope Electronic System Provider (PSE Lingkup Privat), nominate a local representative, and remove flagged content within four hours for urgent categories and twenty-four hours otherwise. With the transition period for Indonesia's Personal Data Protection Law (UU PDP, Law No. 27/2022) having ended in late 2024, EU operators now face a compounding compliance stack that pulls in opposite directions from Brussels.
The PSTE Framework in Plain Terms
The PSTE architecture rests on three load-bearing pillars. PP 71/2019 sets the baseline obligations for electronic system operators. MR5/2020, issued by what is now the Ministry of Communication and Digital Affairs (Komdigi, formerly Kominfo), operationalises those obligations for private platforms. UU PDP, modelled in part on the GDPR but with notable divergences, governs personal data processing across both public and private sectors.
The most contentious element is the takedown timeline. Where the EU's Digital Services Act (DSA) imposes a notice-and-action regime calibrated to risk and proportionality, MR5/2020 sets hard, short clocks. "Urgent" content — broadly defined to include material deemed to disturb public order or violate Indonesian law — must come down within four hours of notification. General categories follow within twenty-four hours. There is no equivalent of the DSA's structured trusted-flagger system or its detailed transparency-reporting framework to balance the speed.
What This Means for European Operators
For a Stockholm-headquartered SaaS firm or a Berlin-based social network, the practical implications are significant:
- Local presence on demand. PSE-Private registration requires identifying a designated person of contact in Indonesia. For smaller European platforms without an Asia-Pacific footprint, that means either hiring locally, retaining a representative service, or accepting blocking risk.
- Reachable systems. Indonesian authorities expect the ability to obtain electronic system content and access for supervision and law-enforcement purposes — a regime markedly broader than what the EU's e-Evidence Regulation contemplates internally.
- Tight notice windows. Even well-resourced platforms struggle to triage, legally assess, and action a takedown within four hours, particularly when content categories are vaguely drafted.
- Data-transfer overhead. UU PDP's cross-border transfer rules, while less restrictive than some early drafts, still require adequacy findings or appropriate safeguards — adding documentation work on top of GDPR Chapter V compliance.
Why This Matters Beyond Indonesia
Indonesia is not a market European platforms can shrug off. It is the world's fourth most populous country and the largest digital economy in Southeast Asia, with internet penetration above 70 percent according to the Indonesia Internet Service Providers Association (APJII). When Komdigi briefly blocked PayPal, Yahoo, Steam, and several other unregistered platforms in mid-2022, the message was clear: registration is not optional, and access can be withdrawn quickly.
The regulatory model is also being studied across the region. Variants of "local representative plus rapid takedown" appear in Vietnam's Decree 53/2022, in India's IT Rules 2021, and in pending proposals elsewhere in ASEAN. For European platforms, what gets built for Jakarta tends to become the template for a dozen jurisdictions.
A Proportionality Problem
From a pro-innovation perspective, the PSTE framework illustrates a recurring pattern in platform regulation: legitimate objectives — child safety, fraud prevention, lawful investigation — pursued through tools so broad that they crowd out due process and chill expression. Four-hour deadlines functionally require automated removal, which research from groups such as the Electronic Frontier Foundation and Access Now has repeatedly shown produces high false-positive rates against journalism, satire, and political speech.
The EU's own approach is not without flaws, but the DSA at least attempts to scale obligations to platform size and risk, mandates statements of reasons, and provides for out-of-court dispute settlement. MR5/2020 offers none of these. The result is asymmetric compliance: European platforms applying DSA-grade safeguards inside the bloc, while operating under a more permissive removal regime in Indonesia simply to keep their services online.
The honest reform path is not weaker rules but better-targeted ones: narrow, defined content categories; takedown timelines calibrated to actual harm; a real appeals mechanism; and transparency reporting that lets citizens see what is being removed and why.
What Brussels and Jakarta Could Do
Three pragmatic steps would reduce friction without sacrificing legitimate enforcement goals. First, the European Commission and Indonesia could pursue a structured digital dialogue, similar to the EU-Japan and EU-Korea tracks, to align on baseline standards for notice-and-action, due process, and data transfers under UU PDP. Second, Komdigi could publish detailed implementation guidance distinguishing genuinely urgent categories — child sexual abuse material, imminent violence — from broader "unlawful content," with longer windows for the latter. Third, EU platforms should invest in regional trust-and-safety capacity rather than waiting for a blocking notice to force the issue.
Indonesia's digital economy is too important to disengage from, and its concerns about platform accountability are not unreasonable. But proportionality cuts both ways. A rules-based, evidence-based framework would serve Indonesian users better than the current speed-over-accuracy regime — and would let European platforms keep building in one of the most dynamic markets on earth.
